No Access to Justice; Prisoners face pathetic conditions in Fata By Anwar Shah Orakzai

‘Imprisonment of innocent people for no crime and without any access to justice’ is one of the most violent side of the Fortier Crimes Regulation (FCR) in Fata for the human rights.
The Tribal Post has accessed and arranged meetings with persons imprisoned in the lockups (jails) of the Political Administration and their family members.
On 22 August 2015, in lower Kurram Agency two rival families of Khaista Khan and Sheraz Gul opened cross firings on each others. In the result, Aziz Gul son of Khaistan Khan was killed while Sheraz Gul got injured. Nawaz Zareef son of Sheraz Gul was arrested, and imprisoned by Political Administration. He is in jail under FCR for the last two years.
“Two years on, I am in jail and my case is not preceded by Political Agent,” said Nawaz Zareef who was speaking behind the bars to The Tribal Post.
“This incident occurred because of prior pity children quarrel, now I regret for it. Now, I also want a judicial trial but so far, I am not presented before Political Agent or any Fata tribu nal and nor I will be given the right, I believe,” added Nawaz Zareef, “This is injustice and cruelty.”
Federally Administered Tribal Areas’ people are deprived of basic human rights enjoyed by other citizens of Pakistan under the constitution of 1973. Fata is still governed under British colonial-era law known as the Frontier Crimes Regulation (FCR), which was first implemented in 1901 with the aim to subjugate frontier independent tribes.

Political Administration’s cruel attitude is not limited to public, but their own employees also became its victims. In 23 June (Last Ramadan), two huge blasts occurred in Parachinar, Kurram Agency. During blast hours, a political ‘Muharrer’, Ahmed Ali, was arrested, and now he is in jail of Political Administration without any crime.
“The blast occurred at Turi gate, and I was arrested from Sabzi Mandi, about a kilometre distance,” imprisoned Political Muharrer, Ahmed Ali, told the Tribal Post.
“It is strange that Political Muharrer on duty at Turi Gate is not arrested, and I am behind bars, adding so far my case is not preceded. I request for giving me a chance of defence, and inquiry,” added Ahmed Ali.
“A government official is facing such hurdle in access to justice then what about common people,” Ahmed Ali added.

Ahmed Ali’s wife Nazeera bibi told The Tribal Post, “We are facing financial problems as my husband salary was stopped by them. I have no male family member that helps us in bringing household items from Bazaar. I have two sons and two daughters who now often remained absent from School because of none to take care of them. I am facing mental Trauma.”
Prisoners under the FCR Law have been facing terrible living conditions inside jails. The administration is more careless about their health and other basic rights as most case against them have no official records. Such prisoners were never presented before any tribunal or any court in Fata.
On condition of anonymity, another Political Muharrer told Tribal Post the situation of prisoner under FCR, “People are imprisoned for not only for an unending time, but their living conditions are worsening. They are provided with substandard foods, no clean drinking water and no easy access to toilets and washrooms. They (Political Administration) are not handling and treating prisoners like human beings.”

The FCR is misused widely in Fata. Without any prior permission of Political Administration’s officials, the Khasadar and Levies forces personnel do raids on houses, insult women, take bribes, and even resort to use of torture. They arrest people for unlimited time and never disclose their crimes.

However, officials at Fata Tribunal claim that they provide justice to prisoners using the same FCR Laws. Fata Tribunal’s Registrar Sajjad-ur-Rehman told Tribal Post that no innocent person is kept in jail for long time.
He said that family members of prisoners could appeal in the Fata Tribunal. “The Tribunal investigates such cases and if anyone is found innocent, it orders the Political Administration to release him,” said Sajjad.
Ex. Parliamentarian and a prominent politician Muneer Khan Orakzai, told The Tribal Post, that long before, he informed the Political Administration of keeping innocent people in jails. “There are such prisoners who have not committed any crime. These people are without trials in jail for years. I also have informed the human rights organizations about issues of prisoners,” he added.
Muneer Khan Orakzai and other local leaders are trying to raise the issue of ‘FCR prisners’ with the Pakistan Army authorities to demand justice for them. Tribal people are also hopeful with the changes took place in Fata after military operations and discussion over Fata widely on national and international level.
“Now we are hopeful, maybe Pakistan Army after being launched in Fata, help us. Such prisoners will be provided with justice. Now the situation is changed, and it will be not easy for Political Administration to do injustice with people,” Muneer Orakazia added.
Nevertheless, Political Muharrer, Muhammad Riaz, denied arresting innocent people and violating human rights under the FCR Laws. “No innocent person is arrested. Those arrested are involved in illegal activities. There is no prisoner who is below 18 years or above 65 years or lunatic etc,” he said adding that prisoner’s cases undergo trials of Political Administration,” Riaz told the Tribal Post.
Collecting prisoners’ data is difficult because Political Administration is not allowing to do so in Fata.
While answering a question regarding the arrest of Political Muharrer Ahmed Ali, Muhammad Riaz said that he was arrested because he failed to note ‘details of a suspicious vehicle passing by the check post under his duty.
As an effort for the tribal people to have access to justice, Fata Tribunal was introduced in 2011 by making amendments in section 55A of the FCR and formally constituted in May 2015. The Tribunal is consisted of a chairman and two members, appointed by the governor of KP.
According to the ‘Fata Tribunal’ law of FCR, the Political Administration is bound to finish any pending case of prisoners within three months otherwise it will be considered as violation of the law and the Administration will be responsible.
The Registrar Sajjad said that Fata Tribunal has currently 336 registered cases. He said that the tribal people should be aware about the legal process how they could get access to justice under the Tribunal.
Answering the question that why large number prisoners are still deprived of access to Fata Tribunal, Sajjad said, “It is due to lack of awareness. Tribunal’s Chairman visits different Agencies time by time. Sometimes innocent prisoners are released on the spot while the Chairman visit jails in Fata.”
The Registrar told Tribal Post that anyone could submit a case at any time in Fata Tribunal.

On the other hand, human rights organizations and activists also make their efforts for justice for the ‘FCR-prisoners’. Human Rights Committee Pakistan (HRCP) is one of such organizations. HRCP’s president, Shahidullah told the Tribal Post that they are working for such prisoners. “We are trying to provide them with justice, but so far done nothing practically. Collecting such prisoners’ data is difficult because Political Administration is not allowing and cooperating,” Shahidullah said.
‘Political Agent Jirga’ is subordinate and unable to deliver justice. Aggrieved party can appeal to Fata Tribunal, but the case either got delay or if decided, then ignored by Political Agent. There is a drastic need of reforms to replace FCR with a new Judicial System so that provide local with easy and speedy justice in Fata.
Since Pakistan came into being, successive governments initiated various Fata-Reforms but in vain. Present PML (N) government formed a Fata reforms Committee that has proposed replacement of FCR with Tribal Areas Rewaj Act-2016.
In Fata, the Tribal Areas Rewaj Act-2016 implementation is yet to be seen in practice. Tribes are still governed under FCR. Even FCR’s implementation is gone more fragile and those tribes people imprisoned in jails are without access to justice; “the so called Political Agent-Jirga”.
PARACHINAR, 21 August: A jirga of Watizai tribe on Sunday decided to set fire to the houses of women involved in drug smuggling in Lower Kurram Agency. The jirga held in Mandori area of Lower Kurram took several decisions to control drug smuggling and drug peddling in the agency. During the jirga it was decided that complete ban will be imposed on sale and purchase of drugs. It was decided that strict action would be taken against the violators of the ban. The jirga decided to impose Rs 100,000 fine on shopkeepers involved in drug peddling whereas facilitators of drug peddlers would be fined Rs 500,000. Moreover, Rs 1,000,000 fine would be imposed on those who were found involved in smuggling of drugs in their vehicles. The jirga constituted a 20-member committee to be headed by Malak Haji Badshah Khan for action against drug peddlers and drug smugglers. Local people have welcomed the jirga’s decisions. Malak Muhammad Ayub, jirga member told TNN that the jirga has decided to fine shopkeepers who were found involved in sale of hashish, heroin and wines. He said that houses of women drug peddlers and smugglers would be demolished as a punishment.

وفاق کے زیر انتظام قبائلی علاقے(فاٹا)کرم ایجنسی میں وتیزئی قوم کی جانب سے گزشتہ روز منشیات کے خلاف جرگے کا انعقاد کیا گیا جس میں منشیات سمگل اور فروخت کرنے والے مردوں کوبھاری جرمانہ جبکہ خواتین کے گھروں کو نذر آتش کرنے کا فیصلہ کیا گیا۔
مندوری کے علاقہ میں ملک حاجی بادشاہ خان کی سربراہی میں منعقد ہ جرگے کے دوران 20رکنی کمیٹی تشکیل دی گئی جو منشیات کے خلاف کارروائیاں کرے گی اور انہیں قبائلی جرگے اور مشران کی حمایت و تعاؤن حاصل ہوگا۔
جرگے میں فیصلہ کیا گیا کہ اگر کوئی شخص دکان میں منشیات فروخت کرتے ہوئے پکڑا گیا تو اسے ایک لاکھ روپے جرمانہ کیا گیا جائے گا اسی طرح منشیات فروش کی حمایت کرنے والے سے 5 لاکھ روپے جرمانہ جبکہ منشیات سمگل کرنے کے دوران پکڑے جانے والے ملزم سے 10 لاکھ روپے جرمانہ لیا جائے گا۔
جرگے نے بتایا کہ اگر منشیات کی سمگلنگ میں خاتون ملوث پائی گئی تو اُس کے گھر کو نذر آتش کیا جائے گا اور اگر کسی نے جرگے کا فیصلہ ماننے سے انکار کیا تو پورا گاؤں اس کے غم اور خوشی میں شرکت نہیں کرے گا۔
جرگے کی جانب سے کئے گئے ان فیصلوں پر لوئر کرم کے مکینوں نے خوشی کا اظہار کیا ہے اور کہا ہے کہ علاقے میں منشیات کی خرید وفروخت میں اضافہ ہوچکا تھا جس سے منشیات کی لت پڑنے کے خوف سے بچوں کے والدین بھی پریشان تھے ۔
یاد رہے کہ اس سے پہلے چھوٹے گاؤں چھپری،پڑاؤ،اور دیگر دیہاتوں میں بھی منشیات کے خلاف جرگے ہوئے تھے جو کامیاب ہوئے ہیں۔

SADDA, 8 August: A committee has been formed in Kurram Agency to help students who cannot afford admissions in colleges despite coming on merit due to financial problems.
Kurram Education Trust member Hazrat Khan said the committee comprises eight members including doctors, lecturers and Ulema. He said the chairmanship of the committee has been given to former education officer Sardar Muhammad Khan. He said the committee will help those students who qualify for admissions into military, cadet colleges and PAF colleges but could not afford admissions there due to financial issues.
“Our Trust will help those talented poor students who will qualify the Educational Testing and Evaluation Agency (ETEA) entrance test, cadet college admission test or other such exams. This committee will be run with donations provided by well off people,” Hazrat Khan told TNN.
Alam Khan, a local resident, appreciated the efforts of the committee and said their endeavours will save the future of many deserving students.

کرم ایجنسی میں ان طلباء کی امداد کے لیے کمیٹی تشکیل دی گئی جو کوالیفائی کرنے کے باوجود اچھے کالجز میں داخلہ نہیں لے سکتے۔ ممبر کمیٹی حضرت خان کے مطابق کرم ایجوکیشن ٹرسٹ کے نام سے قائم یہ کمیٹی آٹھ ارکان پر مشتمل ہے جن میں ڈاکٹرز، لیکچرارز اور علماء کرام شامل ہیں جبکہ اس کی سربراہی سابق تعلیم افسر سردار محمد کو دی گئی ہے۔ انہوں نے مزید کہا کہ ٹرست مخیرحضرات کی مدد سے چلایا جائے گا جبکہ ایسے طلباء کی مدد کی جائے گی جو ایٹا، کیڈٹ کالج یا دیگر اچھے کالجز کے لیے ٹسٹ پاس کرنے کے باوجود وہاں داخلہ لینے کی استطاعت نہیں رکھتے۔ ٹی این این کے ساتھ گفتگو کرتے ہوئے عالم خان نامی مقامی شخص کا کہنا تھا کہ کمیٹی کی تشکیل سے غریب طلباء کو کالجز میں داخلہ لینے کے سلسلے میں آسانی رہے گی۔

According to Kohat Board controller Kaleem Ullah, a complaint was received that student Anees Ahamd, who is the son of principal Bagan of Beacon Degree College, attended only one paper and didn’t appeared in rest of the papers. The complaint which he received from Tikka Khan, who was the examination superintendent at Government Degree College Bagan, read that how he secured top position without attending all the papers. Sources added that he even didn’t entertained his first paper fully. He also solved his practical illegally. Some of the students of the Bagan College also threatened to stage protest against these irregularities. It is pertinent to mention here that a similar case was reported in few years ago. The Kohat Board had cancelled Raees Ahmad’s daughter exams on similar complaint.

کوہاٹ تعلیمی بورڈ نے گیارہویں جماعت کے امتحان میں کرم ایجنسی ٹاپ کرنے والے طالب علم انیس احمد کے خلاف انکوائری کمیٹی قائم کردی ہے۔
انیس احمد، بگن ڈگری کالج کے پرنسپل رئیس احمد کا بیٹا ہے جس پر الزام ہے کہ اس نے امتحان کے تمام پرچے نہ دینے کے باوجود کرم ایجنسی میں سب سے زیادہ 432 نمبر حاصل کئے۔
بورڈ کنٹرولر کلیم اللہ کا کہنا ہے کہ انیس احمد کے خلاف انہیں بگن ڈگری کالج کے سپرنٹنڈنٹ ٹیکہ خان کی جانب سے شکایت موصول ہوئی تھی کہ طالب علم انیس احمد نے صرف پہلا پرچہ حل کیا تھا جس کے بعد اسے امتحانی ہال میں نہیں دیکھا گیا۔
دوسری جانب ذرائع کا کہنا ہے کہ انیس احمد پہلے پرچے کے دوران بھی مقررہ وقت سے 2 گھنٹے پہلے ہال سے نکل گیا تھا جبکہ پریکٹیکل بھی غیر قانونی طریقے سے اپنے والد کی نگرای میں حل کئے ہیں۔
بگن ڈگری کالج کے بعض طالب علموں نے واقعہ کی تحقیقات نہ ہونے کے خلاف احتجاج کی دھمکی دی تھی تاہم بورڈ کنٹرولر نے کہا ہے کہ انکوائری کےلئے کمیٹی پہلے سے قائم کی گئی تھی۔
یاد رہے کہ چند سال قبل بھی ایسی ایک شکایت سامنے آنے پر کوہاٹ بورڈ نے بگن کالج کے پرنسپل رئیس احمد کی بیٹی کا امتحان منسوخ کردیا تھا۔

ملک بھر کی طرح فاٹا میں بھی یوم آزادی کی تیاریاں جاری ہیں۔ تحریک آزادی کے حوالے سے کرم ایجنسی کےعوام خصوصاً بچوں میں شعور پیدا کرنے لئے پاک فوج کے 151 ونگ کے زیر اہتمام گورنمنٹ ہائی سکول علیزئی میں تقریری مقابلوں کا انعقاد کیا گیا جن میں مختلف اسکولوں کے بچوں نے حصہ لیا۔ اس موقع پر قبائلی مشران اور ایجنسی کے عوام کثیر تعداد میں موجود تھے۔مقابلوں میں پہلی بیس پوزیشنیں حاصل کرنے والے بچوں میں انعامات تقسیم کیے گئے۔ ٹی این این سے بات چیت کرتے ہوئے 151 ونگ کے کرنل نوید انورنے کہا ہے کہ پروگرام کا مقصد چودہ اگست کے حوالے سے بچوں میں شعور پیدا کرنا تھا۔ انہوں نے وطن عزیز سے قبائلیوں کی محبت کو سراہتے ہوئے کہا کہ امن و امان کے قیام میں قبائل نے بھرپور ساتھ دیا ہے اور امید ہے کہ مستقبل میں بھی ساتھ دیں گے۔ جشن یوم آزادی کے حوالے سے کرنل نوید نے بتایا کہ یکم اگست سے علیزئی کے ایف سی قلعہ میں ہر شام آتش بازی اور چراغاں کی جاتی ہے۔ انہوں نے عوام سے بھی اپیل کی کہ یوم آزادی کے موقع پر آتش بازی کے ساتھ ساتھ گھروں میں چراغاں بھی کریں۔
Function Held At Kurram School To Mark Independence Day Celebrations

SADDA, 13 August: A function was organised in Kurram Agency as part of Independence Day celebrations on Saturday.
The function was organised at Government High School Alizai under the aegis of Thall Scouts which was attended by a large number of students and tribal elders. Debate competition on the topic of Independence Day was also organised on the occasion.
Colonel Naveed Anwar of Thall Scouts, who was chief guest on the occasion, said the tribal elders are extending full cooperation with them for ensuring peaceful environment. He said Independence Day will be celebrated in Kurram Agency with full vigour and zeal this year.
“The young generation and our next generation need to know the importance of independence. Our elders have achieved independence for Pakistan after great sacrifices,” Colonel Naveed said.
PARACHINAR, 13 August: Father and his daughter suffocated to death while two other people of the same family fell unconscious after inhaling poisonous gases while cleaning a well in Sathin area of Lower Kurram Agency on Sunday. According to local people, Haji Ajmeer and his daughter were cleaning a well in their home when they fell unconscious after inhaling toxic gases. While cleaning the well, they inhaled poisonous fumes and fainted. Noticing that the Haji Ajmeer and his daughter were incapacitated, his brother and nephew jumped into the well to rescue them. However, they did not realise that the well was full of toxic fumes and fainted as well. Local residents rushed to the well and rescued the four people from the well. However, Haji Ajmeer and his daughter were suffocated to death. The two unconscious people were first shifted to Sadda Hospital and were later shifted to Peshawar Hospital and described to be in critical condition. The bodies of two brothers were handed over to their heirs after completing legal and medical formalities.

لوئر کرم کے علاقے اپر ساتین میں کنویں کی صفائی کے دوران دم گھٹنے سے ایک ہی خاندان کے 2 افراد جاں بحق جبکہ 2 کی حالت غیر ہوگئی۔
لوئر کرم کے علاقے لوئر ساتین میں حاجی اجمیر نامی شخص اپنی 16 سالہ بیٹی کے ساتھ گھر کے اندر موجود کنواں صاف کررہا تھا کہ اس دوران گیس بھرنے سے دونوں بے ہوش ہوکر کنویں میں گرگئے، گھر میں موجود 18 سالہ سمیع اللہ اور30سالہ بسم اللہ خان نے دونوں کو نکالنے کی کوشش کی تاہم وہ بھی کنویں میں اترتے ہی گیس سے بے ہوش ہوگئے۔
واقعہ کی اطلاع ملنے پر مقامی افراد نے اپنی مددآپ کی تحت چاروں افراد کو کنویں سے نکال کر صدہ ہسپتال پہنچا دیا جہاں حاجی اجمیر اور اس کی بیٹی جانبر نہ ہوسکی جبکہ متوفی اجمیر کے بھائی سمیع اللہ اور بھتیجے بسم اللہ خان کو تشویشناک حالت میں طبی امداد کیلئے پشاور منتقل کردیا گیا ہے۔

کوزه کرمه ایجنسۍ کښې د کوهۍ صفائي دوران زهریلا ګیس له وجې پلار او لور مړه او د کورنۍ دوه نور کسان بیخوده شوې دې. د ساتین سیمې مقامي خلکو تر مخه حاجې اجمیر او د هغه لور کور کښې د اوبو کوهی صفا کولو چې ګیس جمع کیدو له وجې بیخوده شول. دې دوران د اجمیر ورور او وراره د هغوې راویستلو لپاره کوهی ته کوز شوې ولې هغې هم بیخوده شوې. وروسته د کلي نورو څلور واړه تنان کوهې نه راویستې ولې اجمیر او د هغه پیغله لور پکښې ساه ورکړې ده. نور دوانړه تنان آول د صدې هسپتال او وروسته مرګونې حالت کښې پيښور ته منتقل کړی شوي دي.
